1.2 Union Rights

Purpose of these provisions

1. The Parties recognise that the purpose of clause 1.12 is to benefit the University’s employees by facilitating the provision of effective and accessible industrial representation, including workplace delegates.

2. A workplace delegate has the same meaning as under the Act. In addition to the rights conferred by this Agreement, a workplace delegate is entitled to exercise delegates rights in accordance with the delegates’ rights term of the applicable modern award.

3. In the event of inconsistency, a term in this clause that is equal or superior will prevail over the Modern Award.

Union facilities and representational rights

4. The University will provide the ACU Branch of the NTEU and the CPSU respectively with the following services and facilities free of charge:

   1. an office and associated meeting room each at the ACU Branch President’s home campus;

   2. access to the internet and email; and

   3. access to the University’s intranet.

5. The University will include web links on the University intranet to the websites of the ACU Branch of the NTEU and CPSU respectively.

Union communications

6. The Branch President of the NTEU and the NTEU Organiser and the Branch President of the CPSU and the CPSU Organiser may access the employee directory for the purposes of finding the contact details of and communicating with University employees for union business.

7. Employees are entitled to union-related use of University-provided email and web access such as meeting invites and broadcast emails from the ACU Branch President of the NTEU or CPSU respectively to employees.

Union Activities

11. An employee who has been elected to the Branch Committee of the NTEU and the CPSU will be allowed reasonable time off during working hours or a reasonable workload allocation for the conduct of union business.

12. The University will provide the Branch President of the ACU Branch of the NTEU and the CPSU respectively with 50% paid time release, at their ordinary rate, each week to enable them to perform their union-related duties.

13. The NTEU and the CPSU may use university facilities to hold members meetings during lunch breaks and may each hold up to five (5) paid union meetings of up to one (1) hour duration per year during working time. Employees will be able to attend these meetings during working time. The Chief People Officer will be notified upon each occurrence of paid union meetings by the respective union.

14. The NTEU and the CPSU may provide the University with union information materials which the University will make available to all employees on the University’s intranet site. The University will provide an updated employee list to the Branch Organisers of the NTEU and the CPSU at the commencement of each month.

Trade Union Leave

12. Union delegates from the NTEU and the CPSU will be entitled to up to seven (7) days paid time during normal working hours in any one calendar year for the purpose of attending Union courses or seminars or union meetings such as Division and National meetings. This leave will count as service for all purposes but is non-cumulative.
